Abstract: Municipal Legislative ‘Reform’ through the Lens of Politics and Techno-Bureaucratic Processes

In India, different municipal legislations and the processes of how they are passed in the Union Government, the Parliament, or the state legislatures, illustrate a wide variation in the role of bureaucracy, the legislature, civil society, academia, etc. This talk will present a case study of such instances, and their implications for government, assemblies, and parliament. This will be addressed through the example of the 65th CAA (as passed by the Lok Sabha-1989), 74th CAA (passed by LS/ RS and 2/3rd state assemblies-1992-93), the specimen (model) municipal law 2002-03- by USAID, and passed by various state governments.

The speaker has used a variety of original and secondary source materials as well as replies to RTI from various institutions and Ministries of Government, etc, for over 60-70 questions to illustrate these cases. Different key publications, reports, and legislative measures have also been examined for this. As there is constant pressure on states to introduce new reforms, the speaker believes it will become increasingly important to identify which are those processes that could be used to point the way ahead.
